Hello everyone. My name is Ryan and am really desperate. I received an injury a few years ago that was not work related. I have a herniated disk in my back. I do heavy lifting as a job and obviously this is affecting my work. So I went to a few different doctors and finally ended up at a neurologist who told me in addition to the herniated disk that my spine is dissolving.
Now,I work for Walmart and they will make no "light duty" exceptions. I cannot perform my job at all. I can barely stand for more than 20 minutes at a time. My question is, If I quit based on my medical condition would I be likely to recieve UE benefits until I can get enrolled into the SSI program?
I cant do my job. Should I just get myself fired? I know this is a weird situation and i really am at my wits end on what to do financially. Please any help would be greatly appreciated.
Thank you.
Ryan. |

This is a question you should be aiming at someone who can answer your questions concerning *disability* benefits, not unemployment. Sounds like another typical case where walmart is trying to screw over somebody.
If you can get a doctor to reveal to you the extent to which you are considered to be disabled, and meanwhile temporarily write you off work due to injury while he runs tests, what might happen is that you find out you qualify for either full or partial disability benefits and can quit there to go work elsewhere. A worst-case scenaio is that they refuse to accept the doctor's excuse and fire you, and then you can fight that and get UC

This situation isn't as unique as you think. I am a former PA Unemployment Compensation Claims Examiner and can tell you that you probably will NOT qualify for unemployment benefits. You must be able and available for work and, according you, you cannot work at all. Is that true, or could you do some kind of sit-down job as a receptionist or something? If you truly cannot do ANY kind of work, then you are ineligible. I do believe you should pursue the disability angle, not SSI. SSI is Supplemental Security Income and not disability. You need to apply for Social Security Disability but be prepared for a long wait. Again, look at your situation and see if you can do SOME kind of work. I usually do not advise this but perhaps you should quit Walmart for health reasons and file an unemployment claim. If not, they may fire you for another valid reason because you are not working. But make sure you can convince the unemployment people you can do some kind of work.

Let me ask a general question, when you got this job at Walmart did they know about your medical condition? If they did and hired you then I think this is very unfair on their part. If they did not know, then if you don't quit your job, you may get fired, for not doing the work. Call SSI Disability to find out answers.
Hope everything turns out good for you! |
