My fixed term should be end of May, but my boss on middle of march turned to me said I have done the crab job, why she should pay me. I asked her back what job I done the crab, then she changed to another subject said I was dishonest for my timesheet, I said to her I was very honest for keep my timesheet cerrect, how can you as a managing director saying that. then she said to me I chatted with other workmates during work, I said to her I did not, when I came the morning I said hello to them, when I when to tolit passed to them said hello to them, is this you call chat?

......

finally, she said you can go now, I asked her back: are you sure? she said yes. Then I worked out the door.

In my final payment, I was short pay by 5 hours and 14hours short by accrual holiday.

I wrote to her this the wages short and expexted her dismissal confirmation.

She replied me the wages not short; I was not dismissed by the company, is I wanted to terminate employment early without 1 month notive to the company.

Bloody hell, she can say something completely difference!

Because I have not worked there for 1 year time, ICAS cant help.

Now,
1. my question is how I can get my short pay back;

2.how I say to my new employer the reference problem from this company? (I got reference problem, I dont trust she will give me a reasonable ref to me)

A really big headache!

I don't think a year later that the pay issue is something that could easily be pursued without a lawyer, which would cost a small fortune. On this part, it might be easiest to just cut your losses. As for the reference problem, you could always put 'do not contact' or try to get a good reference from a coworker rather than the old boss.

I doubt if it's worth any further dispute with this person. There's no sign that you'll get any reasonable answers.

Probably best, when talking to a new employer,(if they ask) just to say:

1. You have a dispute with these people about your leaving the company,

and

2. That your version of events and theirs are total opposites.

That's nothing less than the truth.

One thing you need to know, though:

Don't badmouth this clown, however much they deserve it.

A new employer might think you're covering something up, or not being honest, and blaming the employer, which you definitely do not need. It creates a bad impression.

Stick to the basics, don't say any more than Points 1 and 2.

Thanks a lot for Paul and Lexa!

Now I cant get my short payback and cant get reference from this employer, I feel I am big loser.

This owner just had a baby, so I guess she would say she maternity leave, but actually not, she still keep eye on her business.

I think she was not happy with me that she asked me to keep eye on other staff, I refused to do so. I said to her: everybody is working hard, they do their job properly, if sometimes made mistake, then their line manager will sort it out.

Next day, she put an adv. on jobcentre to recruite a new staff above my position. following 2 weeks, she interviewed 1 person, and he is successfull for that position, then 3rd week I got sacked, the 4th week, new staff started to work.

One person who still works there told me, that new staff likes boss wants to find out everything going on there.

So my point is she knows what is her business gets on and she has done a lots damages to other colleage, I did not involved any case, but I knew.

When I worked there I was very very carefully to do everything, but still same situation with others.

I suggest all of you dont work small company, at least they have a HR dep., otherwise dont work for them, you can learn from my experience!
