I just got a notice of overpayment from UI stating I quit my job and should of never been allowed to collect unemployment. I put down that I was layed off due to winter conditions. My boss told me to take the rest of the winter off and call him back in the springtime when I was ready to work. Now the company I worked for said I quit and never called back. It is my word against thiers and now it would seem I have to pay back the 6k I got from UI and a fine of 6k.

The notice I got from UI says the overpayment and penalty are because I knowingly witheld or willfully misrepresented information to get benefits. How am I supposed to prove that they laid me off and I didnt quit when its their word against mine and how can UI charge me.

I asked the girl from from UI why my employer never contested my filing in the first place and then turn around after I get benefits and say I quit my job. The guy that told me to take the rest of the winter off told the UI worker I called in that day and never came back to work.

How can I fight this?

It is possible to contest this determination and win. I would suggest that you get a competent Unemployment Representative to assist you. It is your word against the employer's but with proper objections and cross-examination you can prove your point.

Specific details will certainly help, who, when where and why are the keys to your case, short and succinct answer answering each element of teh law will go a long way to show that you did not receive a "fault" overpayment.

What state are you in?
