I have been with this same company for over 20 years, they continuously dump more and more to the point where I am only a sounding board to get screamed at by customers on the phone, my work is so piled up I am stressing out, breaking out in hives, tossing and turning in bed, I have repeatedly requested help, they ignor me, while everyone else in the office has back up, it has gotten to the point where I was screamed at directly in my face by my superior and his mother..I wrote a letter on email in which they never replied, it is so horribly bad there that I can't think straight, the company is not customer oriented, they lie and cheat...I feel that they are trying to get me to quit..I am harrassed by the employees and the customers. I just can't take it anymore and they think its a joke, when I ask for help they say we'll all under stress then I see others emailing, texting and talking sports.....could I be a candidate for unemployment? Please, Please help.... Crying or Very sad

One thing I'm constantly reminded of when I see posts like this is how few rights American employees have, how much of a disadvantage the unemployment rules are, and how much the myth of management persists, even when it's a farce. If you quit, unless you can establish a very strong case, you wouldn't get benefits. There are so many issues here.

This is the situation about quitting and getting unemployment benefits:

This is the section of the law that it refers to, Section 402(b) of the PA Unemployment Compensation Law:

Quote:
(b) In which his unemployment is due to voluntarily leaving work without cause of a necessitous and compelling nature, irrespective of whether or not such work is in "employment" as defined in this act:


As you can see, this is a complex legal issue, and you will need pro bono legal advice. From your post, and the look of this legislation, I'd suggest you will also need to document your case to the best of your ability.

We can't offer legal advice. But it would appear that you could at least check with a pro bono lawyer regarding the harassment issues. The workplace is obviously hostile, and you're receiving nothing like correct treatment. In any competent environment, I'd suggest a grievance hearing, but from the sound of this, they couldn't even spell it.

Sympathetic as I am, I don't want to suggest this is an easy call. But this information may cheer you up a bit:

You'll be interested to hear that 70% of Americans who sue their employers, which is 30% of the work force, win their cases. Not a pretty picture of the workplace, but an interesting stat.

The abuse is entirely unacceptable, and it only ever comes from management mediocrities. I've never yet seen an abusive manager who was any use at their own job, let alone managing other people.

Consult your doctor regarding stress issues, you may also have some issues which a lawyer would consider valid grounds for complaint, with medical verification. In situations where your health is affected, there may be grounds for complaint.

Meanwhile, look for another job. Get out of that situation ASAP.

Paul...thank you so very much for your reply...I truly appreciate it...I will take your advice and yes I have been documenting everything all the way to taking photos of my work load with my cell phone, I document via email at my work computer. I am looking for another job for sure..in the meanwhile I will get as educated as I can and again will take your advice.
