Hi All,
Glad I found this site. I have a few questions. I have been working for the same company for 10 months. In those 10 months I have been promoted twice. My reviews have always been stellar and there has been no previous problems with attendance or any disciplinary actions.

I do have Obsessive Compulsive Disorder and about 2 weeks ago entered a very bad stage. At the advice of both my physician and a therapist I was advised to take two weeks off of work and then after two weeks they would re-evaluate me.

I informed my employer of this and at first it seemed no problem. My supervisor told me that she would speak with the HR department on my behalf and we would figure something out.

Her response to me was that I had to return to work on Feb 4. I can return part time if I wish, but instead of being salary I would be hourly and they cannot tell me what those hours would be. After seeing my therapist today, It has been determined I am not well enough to return to work on the 4th. I am not sure how to go about this. If I do not return is that seen as quitting? Or them firing me for not returning to work?

I really need help in making the best decisions in the next few days because if I will be out of work I will need to collect unemployment.

Any advice is appreciated.

Do you have any kind of sick pay that you can collect? I would think that you qualify for it. You are possibly going to need something in writing from your doctor that is treating you. Depending, you may be able to qualify through the unemployment office/state or through your unemployer.

I have letters from both my Primary Care doctor and my treating therapist. My sick leave is being used for the two weeks I am off. I have paid into short term disability but was told this type of situation is not covered by that? Which seems strange to me.

My company does not allow any unpaid leave unless it is under FMLA and because I have not been there 12 months I do not qualify for FMLA.

The stress over this is actually causing my condition to worsen rather then get better as was the point of the two weeks off.

One of the keys to collecting UC Benefits is that you have to be able and available to work. Maybe not in the same job, but at least some type of work.

You should have your doctor release you to perform at least limited duties if possible
