I have a question I am hoping someone can answer for me. I have a felony on my record from almost 5 yrs. ago for bad checks. It was a very stressful time in my life ( lost a young son) and ended up writing bad checks and they put them all together and made a felony. I am currently looking for work in the healthcare field.The last co. I worked for knew about this and hired me. What am I to expect this time around? How can I get this either reduced or taken off my record. I am up to be released from probation. How will this affect my chances of getting a job in the nursing field? Thanks

Sometimes something this old can be expunged [sealed] if you have been good and there have been no repeats. I would inquire into this being possible, and the easiest way to do that is to start with inquiring at the local courthouse about who you need to talk to. Sealed or not, you may be able to find an understanding employer who employs you despite your past. Just be honest about things.

Criminal records kept by the court system are public records and are usually available to employers. The only restriction given by the FCRA (Consumer Report Act) is that an arrest record that is over 7 years old should not be included in an employment background check. However the FCRA gives no time restriction on an actual criminal conviction. Your conviction occured 5 years ago so it will still be included in the criminal check process.
Employers may request court records from every jurisdiction where the candidate has lived. Laws on checking criminal history vary from state to state so you could check for your state what the legalities are.
