long story, here it is,, i need your thoughts..
also i'm sorry if i posted this in the wrong thread i couldn't find an appropriate forum and thread..

In 2006 I was hired by a temp agency to work at a call centre. After 5 months of working my employment was terminated( I was fired, I was having trouble at work due to personal issues my job performance was good)...
So now 3 years later in sept 2009, I saw a job posting for another call centre and where I live there are VERY little jobs available due to the economy and I need to start paying off my student loans because I'm in debt up my rear-end and haven't made a payment in months!.. This job posting wasn't specific on the job so I applied for the job and my resume outlined my different Customer service experience etc ( of course failing to add and mention the call centre job i was fired at, haha).. Not thinking clearly and MUCH to my surprise I was called in for an interview.. So i went to the interview.. and found out the job that's currently looking for employee's was the job I WAS FIRED from 3 years ago through a different temporary agency.. So during the interview I didn't mention that I worked there previously and gave them some references, so 2 days later I get a call back from the different agency and they notified me that my references cleared and they offered a position to start the following week so i agreed and now I have a job again and start orientation in a week..

SO my question is.. I didn't mention in the interview that I worked at that call centre previously.. will they find out?? Since all the payroll and information is kept at the agencies who hired you instead of the actual employment HR place? SHould I have told them? I didn't tell them so i basically lied because I need a job and they probably wouldn't have hired me if i told them i worked there before and they found out I was terminated. Remember these were two different agencies and at call centres the TURN OVER rates are VERY HIGH especially in 3 years time there most likely would be new staff and management. anyways i feel really guilty but i could care less i need a job and am desperate do you think when they hire me and input payroll and SIN information they will find out and fire me again or will I go to jail?? did I commit a crime?.. Did I fraud the staffing agency by not telling I was fired? If they find out when I start working they will ask why i didn't tell them before..

can I have your thoughts on this?? do you know personally know anyone or a family or a friend who have been fired and rehired by the same company by the HR or through different staffing agency's? I don't think it's a big deal but what makes it a big deal is that I lied and failed to mention my previous employment and termination i really hope they don't find out

basically in short, 3 years ago i was hired and fired with staff agency A, then 3 years later hired again with staff agency B without B knowing of my previous employment.. (all for the same job.. except now the job pays 1 dollar and 50 cents more now LOL)

As long as the basis of dismissal wasn't an offense, not necessarily an issue of itself. The call center's current management may not care about this bit, if you got the job on merit and can do it well.

Strictly speaking you are required to give this information. It will come as no surprise to anyone that you didn't mention it, but technically, it's a problem in terms of information supplied on your application. If the employer deems you've provided misleading info, or failed to provide relevant information, they can dismiss you on those grounds.

They can find out if they cross check your SSN, or you received UC as a result of your being fired. That may not happen, there's not much call for it in a high turnover job.

Not necessarily the case: Audit and tax requirements for salaries paid by the employer are involved, which require a full audit trail.

Legally, this is a gray area. We can't give legal advice, by law. To the best of my knowledge it's not a criminal offense.

Again, a legal area, and the question is also whether you needed to tell them this according to their terms of service. If the TOS say you must provide all relevant information, may be a problem.

Some good news here. You're right about it not being a big deal in actual fact. No real injury has been done to either the employer or the agency. They haven't suffered any material damage. The employer and agency may not care at all, for that reason. They've done their business, and it costs them money to undo it. It doesn't really make much sense to create an issue for no benefit to them.

This is really a technical matter: The information about your termination, if provided, may or may not have affected the decision to employ you. It may or may not be an issue that you were fired previously. Since they hired you, my guess would be that it's only relevant because of circumstances, not any real problems.


Choices:

1. Say nothing, let things proceed. It was a million to one coincidence that you wound up going for this particular job. You can truly say that you got worried when you discovered where the job was, and didn't want to say anything, because of the deficient information you gave to the agency. You're in the wrong technically, but no damage has been suffered by either party.

2. Own up, admit to the situation, and see what happens. If they don't care about it, problem solved. At least you can then say that you have given the information, and that absolves you of any further worries.

This is a judgment call. Do you believe the agency or employer will go ballistic, or are they more rational and receptive? Do you know their policies on this subject?

The strictly formal advice: Because of the legal angle, suggest you consult a lawyer about any liabilities. You can also check out your state's labor laws.

also, I have decided to let the agency know. If they accept it great I have a job If not then I will move on with my head held up Smile

It is hard to make a decision for you and for me if run into that kind of problem. In my opinion I will tell them frankly. What it happened for 3 years ago, and i am sure i go up a high level in these 3 years.Telling them you can. Smile Good luck

I'm from the UK and that sounds quite strange, you should really check out your contract to see if they have made some changes.


Perfect CV advice always check your contract!!!
