Sad Im from new jersey.. u.s.a. I was terminated after 6 yrs. because of a Corperate policy.. no violence in our corperation zero tolerance.. touching is violent ,even done in a non violent manner. I keep getting told to let it be ,move on, forget it, I wish I could.
I took the temp.worker that was dealing drugs in the pitney bowes workplace by his collar and told him to stop trying to sell me drugs. Because of my touching him it was considered a violent incident and I was told they were sorry to do this but they had to abide by there policy ,after being awarded an outstanding employee just two weeks prior to this incident,and making the supervision aware of the drug dealing, the tension among the rival groups that worked in my area, my superviser did nothing and told me to mind my own buisness . I understand he has resigned,and also his manager also his no longer there. My case is how can there be a zero tolerance policy when the supervision is not mature enough or experienced enough to deal with issues and take steps to prevent incidents !
I want to bring this to a lawyer that will go up agianst a giant like Pitney Bowes , and show that this zero tolerance policy makes zero sense..
Please read this I wish I knew who wrote it .
Refusing to consider each individuals personel history, and the intentions that inspired thier actions.
Zero tolerance policies deny the unique worth and dignity of every person.
Zero tolerance administered strictly and without regard to mitagating circumstances , may mean liability..
I need legal help and advice and a job

Just to qualify the advice below:

I'm all in favor of removing sleazebags from the workplace, by collar or by boot in the appropriate place. You could also have been said to be acting to some degree at least in self defence from and illegal act.

That said, you've pinned down the problem: Immature, ineffectual management and policies which are "enforced" mindlessly, without regard to circumstances or facts.

"Zero intelligence" would be more like it. The supervisor was obviously ducking as many issues as possible, and management, from the sound of it, may not have known which planet they were on.

Your position at the moment is:

1. You can make a case for yourself, legally.
2. That could take a while, and cost money.
3. You need a job, and some sort of backup, before fighting a case.
4. What you can do is approach current management, explain the circumstances, because the supervisor and manager have gone, perhaps for reasons related to those issues that got you in trouble.

You have a good record with the company apart from that one incident. It's pretty easy to argue the former management made a total hash of it without offending current management.

Try that before looking for legal avenues. It's cheaper, and more likely to get down to the case where something can be done immediately about those issues. You may well be able to make a case for rehiring you, and at least get some vindication for this totally unnecessary situation.

One further thought: If middle management won't listen, top management will, particularly the bit about trying to sell drugs on the premises.

I think what you did was admirable and cannot believe they fired you for it. I think you should get a lawyer and go from there. It would be interesting to see what a lawyer thinks of all this....

thanks for the advice and replies lexa and paul, I have consulted a lawyer and he basically told me that I dont have a case, the state of new jersey is what is called an " AT WILL" which means an employer can terminate any employee at any time for anything, and the fact is I did touch which can be an assault ,also he said I was not discriminated agianst so where is the wrongdoing on pitney bowes part..well I said , its the policy I feel is what is not legal, I still want to file in supreme court, I have another year and Im trying to find a law student or someone in the legal profesion . what a mess.
I like this site and already found some helpful things and ideas in the driving field. Im going to get the passenger endorsement and hopefully find a position as a tour bus driver.
Ohhh, I did go to the corperate big guy at P.B. he was so apolegetic , and would not and could not reverse my termination, his reasoning was that the drug dealer ,after I told him to shut up etc. went and picked up a broom handle and threatend me with it calling me old man I just ignored him but this big guy said that if I had not touched him that none of this would have happened, What a mess.. I truely loved my job !
I will once agian start over.
